Attackers URINATE on Homeless Man — Walk Free

Two young men who filmed themselves urinating on and beating a 68-year-old homeless man until he lost consciousness received probation instead of the seven-year prison sentence prosecutors demanded, sparking outrage from the district attorney and victim.

Attackers Record Brutal Assault

Boaz Winslow Brigham, 21, and Malachy Damien Hayes, 18, pleaded guilty to elderly abuse Monday for their March 20 attack on Douglas Mark in Arroyo Grande. Surveillance footage captured Hayes approaching Mark as he slept in a public park at 1:30 a.m., urinating on him until he woke, then punching him repeatedly in the head. Brigham joined the assault, kicking and punching Mark while recording the attack on his cell phone and shouting references to disgraced artist R. Kelly.

The video shows Hayes kicking Mark so hard his shoe flew off. Mark lost consciousness during the beating and suffered broken ribs, a severe concussion, and required stitches. The attackers later posted a second video to Snapchat, joking about the assault and displaying dried blood on their hands and shoes. Brigham bragged on camera about the urination, using racial slurs to describe their victim.

Lenient Sentence Sparks Outrage

San Luis Obispo County District Attorney Dan Dow called it one of the most shocking cases he has encountered. The judge sentenced both men to four years formal probation after approximately one year in county jail, citing their youth, lack of criminal history, and guilty pleas. Dow had requested the maximum seven-year prison term. Mark, who still suffers headaches and memory problems from the attack, expressed frustration with the outcome and called Brigham a danger to society.

Victim Struggles to Rebuild

Mark had been sleeping in public parks for three years because they offered overnight access and phone charging. He previously worked building sets for Rob Reiner’s Lorimar Studios and as an architectural landscaper before family problems and a decades-old drunk driving incident led to homelessness. A park employee has since provided him temporary housing. Mark described the assault as demoralizing and said the attackers left him for dead. He plans to pursue all legal options available against his assailants.
