Judge Declares Immigration Freeze Unlawful

Judge John McConnell Jr. of Rhode Island issued a 135-page ruling that the administration violated federal immigration law by halting work permits and asylum decisions for applicants from 39 countries. The judge found that U.S. Citizenship and Immigration Services placed lives on hold based solely on birth country, not individual circumstances or wrongdoing. The November directive blocked decisions on asylum claims, work permits, green cards, and citizenship applications under President Trump’s expanded travel restrictions. Judge McConnell noted that many affected immigrants remain without employment, income, or ability to plan their futures. The ruling emphasized that policies punished people who entered the country legally rather than targeting undocumented immigrants as intended.

Administration Faces Legal Pushback

The Department of Homeland Security rejected the ruling as politically motivated, calling it a Democrat playbook tactic to undermine policies through courts. The White House provided no immediate comment on whether officials would appeal the decision. The administration now must resume naturalization ceremonies and application processing that stopped last November. Democracy Forward, the legal nonprofit representing affected immigrants and unions, celebrated the outcome as vindication of constitutional principles.

Judge McConnell addressed a common refrain in immigration debates about following legal channels. He stated this case demonstrates immigrants doing exactly that, only to face government roadblocks after complying with every requirement. The ruling directly challenges the administration’s authority to freeze immigration processing based on nationality rather than individual merit or security concerns.

Immigrant Advocates Declare Victory

Skye Perryman, president of Democracy Forward, stated the ruling reaffirms that federal authorities cannot shut down lawful immigration pathways or discriminate by national origin. Afghan refugee organization AfghanEvac highlighted cases of Afghan allies whose citizenship ceremonies were canceled despite following every legal requirement. President Shawn VanDiver said members faced expired work permits and stalled green card applications after meeting all government demands. The decision affects thousands of applicants who entered the immigration system legally before the November freeze took effect.
